Terms of Sale

Preamble

These Terms of Sale ("Terms") set out the conditions for ordering, paying for and delivering the studies offered by Fizable on the fizable.io website. Any order implies unreserved acceptance of these Terms.

1. Seller identification

2. Definitions

  • Customer: any person who orders a study on fizable.io.
  • Study: the strategic feasibility analysis produced from the Customer's answers, delivered in digital form.
  • Order: the purchase of a study according to the selected tier and options.
  • Tier / Options: the study level (Express, Complète, Premium) and any additional deliverables.

3. Price

Prices are shown in euros, inclusive of all taxes (TTC), with the applicable French VAT (currently 20%) included. The applicable price is the one displayed at the time of the order. Fizable reserves the right to change its prices at any time, with no effect on orders already placed.

4. Order

The order is placed online: the Customer chooses a tier, fills in the questionnaire, selects any options, then proceeds to payment. The order is firm and final upon payment confirmation; a confirmation email summarizing the order is then sent to the Customer.

5. Payment

Payment is made online by bank card through our provider Stripe. Fizable does not store any bank card data. One-off payment is due in full at the time of the order; there is no subscription or recurring charge.

6. Delivery

The study is delivered electronically (a private link to an online dashboard, plus downloadable formats depending on the tier and options), generally within 3 business days from payment confirmation. The Customer is notified by email as soon as it is available.

7. Right of withdrawal

Where the Customer is a consumer, they are in principle entitled to a period of fourteen (14) days to exercise their right of withdrawal, without having to give reasons (art. L.221-18 of the French Consumer Code).

As the study is a digital content / a personalized service whose production begins as soon as the order is placed, the Customer, when placing the order, expressly requests immediate performance of the service and acknowledges that they will lose their right of withdrawal once the study has been fully performed (art. L.221-28, 1° and 13°, and L.221-25 of the French Consumer Code). This agreement is obtained via a dedicated checkbox at the time of payment and confirmed in the order confirmation email.

If the Customer exercises their right of withdrawal after performance has begun but before full performance of the study, they pay an amount corresponding to the service already provided, proportionate to the total price of the order (art. L.221-25). No amount is due if their express request for immediate performance was not obtained.

To exercise their right of withdrawal where it applies, the Customer may use the model withdrawal form set out in the appendix, or send any unambiguous statement to contact@fizable.io.

8. Legal guarantee of conformity

The consumer Customer benefits from the legal guarantee of conformity applicable to digital content and digital services (French Consumer Code). The study is provided as viewable and downloadable files (HTML dashboard, PDF report, and, depending on the tier, office formats), readable with a standard web browser and the usual software. In the event of a lack of conformity, the Customer may contact us at contact@fizable.io.

9. Liability

The studies are decision-support tools generated with the assistance of AI, based on the information provided by the Customer. They do not constitute regulated advice (legal, financial, accounting). The figures, facts and sources must be checked by the Customer before any decision; decisions made on the basis of a study are the sole responsibility of the Customer. TECHNOCARE is bound by an obligation of means in producing the study in accordance with the information provided.

With regard to the consumer Customer, no provision of these Terms has the effect of removing or reducing their right to compensation in the event of a failure by TECHNOCARE to meet its obligations; TECHNOCARE's liability applies under the conditions of ordinary law.

Business customers only: with regard to a Customer acting for purposes within the scope of their professional activity, and to the extent permitted by law, TECHNOCARE's liability is capped at the amount of the order concerned and excludes indirect damages (loss of revenue, profit, data, reputational or commercial harm).

10. Force majeure

TECHNOCARE may not be held liable for the non-performance of its obligations in the event of force majeure within the meaning of article 1218 of the French Civil Code.

11. Personal data

The data collected as part of the order is processed in accordance with the privacy policy.

12. Complaints and mediation

Any complaint may be sent to contact@fizable.io.

In accordance with the provisions of the French Consumer Code concerning consumer dispute mediation, after contacting us and failing a satisfactory response, you may use a consumer mediation procedure free of charge with:

13. Governing law and disputes

These Terms are governed by French law. The parties endeavor to resolve any dispute amicably. Failing that, the dispute will be brought before the competent courts; the consumer Customer may in particular bring proceedings before the court of their place of residence.
